What does MVAC not cover?

MVAC does not cover:

  1. Property damage
  2. Any personal injury award over the first $200,000
  3. Anything which is covered by any insurer – yours or a defendant’s
  4. Any benefit which you are entitled to under any federal or provincial government program (AISH, Worker’s Compensation, Employment Insurance, Victims of Crime Fund, etc.).

About property damage:

MVAC no longer pays for property damage. This is because the provisions of the Motor Vehicle Accident Claims Act that allowed for payment of property damage were repealed effective June 1, 1997.

If an uninsured driver damaged your vehicle and you do not have collision coverage in your insurance policy, you will need to either pay for the damages yourself, or initiate an action in court for a judgment against the person who caused the damages. Motor Vehicle Accident Claims cannot pay the judgment, nor can they collect payment from the uninsured driver on your behalf. This must be handled between you and the other driver.

In most cases, court action could be initiatied through Provincial Court since it is unrelated to the Motor Vehicle Accident Claims Act. To find more information on “Small Claims”, visit the Alberta Courts website.

If you are the victim of a hit-and-run driver and you do not have collision coverage through your automobile insurer, you will be required to pay for the property damages yourself. Even if you have collision insurance, Motor Vehicle Accident Claims will not pay your deductible.
