Maintenance Enforcement Program


If there is a licence restriction in place against the debtor, why is the debtor still driving?

There are two types of motor vehicle actions available to the Maintenance Enforcement Program (MEP):

  • Motor vehicle restrictions: remove the debtor's ability to access motor vehicle services. These prevent a debtor from renewing a driver's licence and vehicle registration or from obtaining a driving abstract.

  • Licence cancellations: allow MEP to cancel the debtor's current Alberta driver's licence. MEP issues a warning letter and allows the debtor 21 days to respond before the cancellation is requested from the Registrar of Motor Vehicles.

    Some debtors choose to drive illegally and MEP has no control of this. Pursuant to section 95(1) of the Traffic Safety Act, driving in Alberta with a cancelled operator's licence is subject to the following penalties:

    • for a first offence, a maximum penalty of $2,000 and, in default of payment, a term of imprisonment of not less than 14 days and not more than six months; and
    • for each subsequent offence committed within one year imprisonment for a term of not less than 14 days and not more than six months.
